These Terms and Conditions apply to purchases from the online shop at samanthadurocher.ca (the “Shop”), operated by Samantha Durocher Buchsdruecker (“we,” “us,” or “our”). By placing an order, you agree to these Terms.
1. HANDMADE ARTWORK
Our products are handmade beadwork created by Samantha Durocher Buchsdruecker and other specifically identified artists, including her mother where stated in the product listing. Each listing will identify the artist who made the piece. Because each item is handmade, small variations in bead placement, color, shape, size, leather, stitching, and finish are normal and are part of the character of the work. Product photographs are representative, but screens may display colors differently.
2. CULTURAL AND NATURAL MATERIALS
Some listings may describe cultural meaning or may include natural materials, such as genuine leather or a small amount of dried sweetgrass placed between the beadwork and backing. Materials will be disclosed in the applicable product description where reasonably possible. These items are artwork and are not sold as medical, therapeutic, ceremonial, or spiritual guarantees.
3. PRICES AND PAYMENT
Prices are shown in the currency displayed at checkout. Unless otherwise stated, taxes, shipping charges, customs duties, brokerage fees, import charges, and currency-conversion fees are not included in the listed product price.
Payment must be successfully authorized before an order is accepted.
We may correct genuine pricing or listing errors and will contact you before proceeding if a correction affects your order.
4. ORDER ACCEPTANCE AND AVAILABILITY
An order confirmation means we have received your order; it does not guarantee acceptance.
We may cancel and refund an order if an item is unavailable, was listed in error, appears fraudulent, cannot legally or practically be shipped to the destination, or contains a natural material that may be restricted by customs or agricultural rules.
We will contact you using the information provided at checkout.
5. PROCESSING AND SHIPPING
We currently ship within Canada and to eligible addresses in the United States. Processing and estimated delivery times shown in a listing or at checkout are estimates, not guarantees. Handmade or made-to-order items may require additional time. Once an order has been transferred to the carrier, delays caused by weather, customs, carrier disruption, incorrect addressing, or other events outside our reasonable control may occur.
Customers are responsible for providing a complete and accurate shipping address. Contact us as soon as possible if an address is incorrect. We cannot guarantee changes after an order has been processed or shipped.
Additional shipping costs caused by an incorrect or incomplete address may be charged to the customer.
6. UNITED STATES ORDERS, CUSTOMS, AND NATURAL MATERIALS
United States customers are responsible for any customs duties, import taxes, brokerage charges, delays, inspections, or restrictions applied by U.S. authorities. Products containing sweetgrass, leather, or other natural materials may be unavailable for U.S. shipping or may require additional review.
We may decline or cancel cross-border shipment of a restricted item and issue a refund for the cancelled item.
Customers must not ask us to misdescribe an item or declare an inaccurate value on customs documents.
7. EXCHANGE-ONLY POLICY
We do not offer returns for refund or accept change-of-mind cancellations after an order has entered processing.
Eligible regular-priced items may be exchanged if you email hello@samanthadurocher.ca within 14 days after confirmed delivery.
To qualify for an exchange, the item must be unused, unworn, unaltered, and in its original condition and packaging. Proof of purchase is required. Do not mail an item back until exchange instructions have been provided. The customer is responsible for return shipping and for the shipping cost of the replacement item, unless the original item arrived damaged or an incorrect item was sent.
We recommend tracked shipping because we cannot complete an exchange for a return package that is not received. Original shipping charges are not refundable or creditable.
The following are final sale and not eligible for exchange unless damaged or incorrect:
All exchanges depend on available inventory. If the requested replacement is unavailable, we may offer store credit or another available item of equal value.
Any price difference and additional shipping charge must be paid before the replacement is sent.
8. DAMAGED, DEFECTIVE, MISSING, OR INCORRECT ORDERS
Please inspect your order promptly. If an item arrives damaged, appears defective, or is not the item ordered, email hello@samanthadurocher.ca within 7 days after delivery and include your order number, a description of the problem, photographs of the item, and photographs of the packaging.
We will assess the issue and, where appropriate, arrange a repair, replacement, exchange, or refund. This section does not limit any rights or remedies that cannot legally be excluded.
For a package marked delivered but not received, first check the delivery location, household members, neighbours, and the carrier’s tracking information, then contact us promptly. We will assist where reasonably possible, but carrier investigations and outcomes are outside our direct control.
9. PRODUCT CARE AND SAFETY
Beadwork, pins, clasps, and small components may present a choking or puncture hazard and are not toys.
Keep them away from young children and pets.
Handle gently, keep dry unless the listing says otherwise, avoid perfumes and chemicals, and store safely when not in use. Natural materials may vary and may be sensitive to moisture, heat, or crushing.
10. INTELLECTUAL PROPERTY AND RESPECTFUL USE
Product photographs, written descriptions, designs, branding, and website content belong to their respective creator or rights holder and may not be copied, reproduced, resold as another artist’s work, or used commercially without permission.
Purchasing an item does not transfer copyright or permission to reproduce the design. Cultural descriptions are provided respectfully and must not be used to misrepresent identity, community authority, or ceremonial status.
11. WEBISTE INFORMATION AND AVAILABILITY
We try to keep product descriptions, photographs, availability, and pricing accurate. The website may occasionally contain errors or experience interruptions.
We may update listings, limit quantities, refuse suspicious transactions, or temporarily suspend the Shop where reasonably necessary.
12. LIABILITY
To the extent permitted by applicable law, we are not responsible for indirect, incidental, or consequential loss arising from use of the website or products. Our responsibility for a claim relating to a purchased product will not exceed the amount paid for that product, except where the law does not permit that limitation.
Nothing in these Terms excludes or limits mandatory consumer rights or liability that cannot legally be excluded.
13. GOVERNING LAW
These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without limiting any mandatory consumer protections that apply in the customer’s place of residence.
14. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version in effect when an order is placed will apply to that order, unless a change is required by law.
